Patches are not automatically applied by running the server. In order to get a new jar, you must re-run the buildtools jar. This will get the latest sources and recompile it and provide you with the jar you need to run the server. If you need a 'fresher on the process, the wiki has a perfect guide for you. http://www.spigotmc.org/wiki/buildtools/ I fail to see how patches being unavailable is an issue here.
